Notarial services

Our activities in the area of notarial services are as follows:

These activities can be divided into 6 main groups:

1. Authentic deeds: This is the main service provided by a notary. Here, he consciously strives for objectivity and impartiality in drafting contracts in their authentic form. These deeds are primarily related to real estate (sale, exchange, mortgage loan) and commercial transactions (incorporation of companies, increase of capital, merger, amendment of articles of association). The authentic form is imposed by the federal legislator to ensure the proper handling of major contracts. Here, the notary has a role of preventive justice to avoid conflicts once the deed has been signed.

2. Original instruments: The new Vaud law on the notarial profession, which entered into force on January 1, 2005, stipulates that for certain documents the orginal copy must be handed to the client. This applies primarily to surety bonds.

3. Authentications: The notary certifies the authenticity of a signature on a document that is submitted to him; under the new law, the signature must be affixed in the presence of a notary, unless the latter already knows the relevant signature.

4. Expert opinions: Vaud procedural law authorises notaries to prepare expert opinions in certain proceedings, notably partition and divorce proceedings.

5. Legal opinions: The notary is often called upon to give his opinion on issues pertaining to real estate or other matters (e.g. succession, company law, interpretation of easements).

6. General advice: The area of law is a vast one and the notary can provide his clients who so request with advice on the transfer of enterprises, both commercial, industrial and agricultural, or on the tax implications of choosing a particular solution.
